Terms and Conditions
Effective Date: August 5th 2025
1. 
General
These Terms and Conditions (“Agreement”) govern the provision of nursery products and landscaping services by Althouse's Nursery and Landscape Company LLC. located at 561 West Main Avenue Myerstown PA 17067, to its customers. By placing an order or engaging our services, you agree to be bound by this Agreement.
2. 
Services Provided
A offers the following services:
We are a full service Landscape Company and retail/wholesale supplier.
Sale of plants, trees, shrubs, and other nursery stock
Landscape design and installation
Lawn care and maintenance
Hardscaping (e.g., patios, walkways, retaining walls)
Custom service agreements may be created for larger or ongoing projects.
3. 
Quotations and Estimates
All quotes are valid for 30 days unless otherwise specified.
Prices may vary due to market conditions, availability of plants/materials, and scope changes.
Changes to the original scope of work may incur additional charges.
4. 
Payment Terms
A 50% deposit is required for all projects exceeding $1,000.
The remaining balance is due upon completion unless otherwise agreed in writing.
Late payments are subject to a 2% monthly interest.
Acceptable payment methods include: [Cash, Check, Credit Card]

5. 
Cancellations and Refunds
Cancellations made less than 7 days before the scheduled service date may incur a cancellation fee.
Deposits are non-refundable
Plant material is non-returnable and non-refundable 

6. 
Warranties
Nursery stock is warranted to be true to type and in good health
7. 
Client Responsibilities
Clients must provide clear access to the job site during scheduled work hours.
Underground utilities (gas, water, cable, etc.) must be marked prior to work. We are not liable for unmarked utility damage.
It is the client’s responsibility to maintain plants after installation unless a maintenance contract is in place.
8. 
Delays
Althouse's Nursery and Landscape Company LLC. is not liable for delays caused by:
Inclement weather
Supply chain issues
Labor shortages
Acts of God or other events beyond our control
9. 
Liability and Insurance
Althouse's Nursery and Landscape Company LLC. maintains general liability insurance.
We are not responsible for indirect, incidental, or consequential damages.
Client agrees to indemnify and hold harmless Althouse's Nursery and Landscape Company LLC.  from any claims arising from the misuse or neglect of installed plants or systems.
10. 
Intellectual Property
Landscape designs created by Althouse's Nursery and Landscape Company LLC.  remain the intellectual property of the company unless otherwise transferred in writing.
11. 
Dispute Resolution
Any disputes will first be addressed through good-faith negotiation.
If unresolved, disputes shall be settled by mediation or arbitration in Lebanon County District Court.
12. 
Governing Law
This Agreement shall be governed by the laws of the State of Pennsylvania.
